Acceptance of Terms

By downloading, installing, or using Yosemite High Country Map ("the app"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app.

Description of Service

Yosemite High Country Map is an informational and recreational application that displays an offline topographic map of Yosemite's high country, together with a hike catalog, trail routing, placemarks, GPS track recording, and GPX import/export features.

The app is designed for trip planning and reference purposes only. It is not a certified navigation device and is not intended to replace official maps, current National Park Service information, or sound backcountry judgment.

NOT A SUBSTITUTE FOR BACKCOUNTRY PREPAREDNESS

WARNING: Do not rely on this app as your only navigation tool in the backcountry. All data in this app — including trails, routes, hike statistics, elevations, and water features — is provided for reference only and may be inaccurate, incomplete, or outdated.

Map data is derived from public sources (USGS lidar and hydrography, OpenStreetMap) and may differ from actual conditions due to:

Trail reroutes, closures, and damage since the data was collected
Seasonal snow cover obscuring or altering routes
Water sources that are seasonal or dry in drought years
Data collection limitations and processing artifacts
Changing NPS regulations, permit requirements, and closures

Always carry a paper map and compass, check current NPS conditions and permit requirements before your trip, and make your own judgment in the field.

Assumption of Risk

You acknowledge that wilderness travel, hiking, climbing, and other backcountry activities are inherently dangerous and carry significant risks, including but not limited to falls, exposure, altitude illness, injury, and death. By using this app, you voluntarily assume all risks associated with your activities, whether or not you use information from this app in connection with those activities.

You agree that you are solely responsible for your own safety and the safety of others in your party. The app does not replace proper training, equipment, experience, or judgment.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE DEVELOPER OF YOSEMITE HIGH COUNTRY MAP SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Personal injury, death, or bodily harm
Property damage or loss
Loss of data or information
Any damages arising from reliance on trail data, routing, hike statistics, or any other information provided by the app

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise), even if the developer has been advised of the possibility of such damages.

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

The developer does not warrant that:

The map data or any other information displayed is accurate, complete, current, or reliable
The app will meet your requirements or expectations
The app will be uninterrupted, timely, secure, or error-free
Any errors in the app or its data will be corrected

Data Accuracy

All data displayed in this app — terrain, trails, routes, hike statistics, and water features — is derived from publicly available sources and is provided for informational purposes only. The developer makes no representations or warranties regarding the accuracy, completeness, or timeliness of any data. Actual trails, conditions, and regulations may vary significantly from what is displayed in the app.

Indemnification

You agree to indemnify, defend, and hold harmless the developer of Yosemite High Country Map from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the app, your violation of these Terms, or your activities in connection with any information obtained from the app.

User Conduct

You agree to use the app responsibly and in compliance with all applicable laws and regulations, including National Park Service rules, wilderness permit requirements, and Leave No Trace practices. You agree not to use the app as a substitute for official information or sound backcountry judgment.

Intellectual Property

The app, its design, features, and original content — including the basemap rendering and hike catalog — are the intellectual property of the developer. USGS elevation and hydrography data is in the public domain; OpenStreetMap data is © OpenStreetMap contributors and used under the ODbL. This app is not affiliated with or endorsed by the National Park Service, USGS, or the OpenStreetMap Foundation.

Changes to Terms

The developer reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the app after any changes constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
